Allegation(s)

Issue 1: The Parent alleged that the provision of the Student’s IEP services were severely disrupted during the period while he was placed on instruction in the home pending a new out of district placement (November 1, 2024, through September 2, 2025). During this time, the Student’s September 17, 2024, IEP was in place. For the purposes of this complaint investigation the one-year look back period extends back to February 9, 2025. (34 CFR § 300.17(d))

Issue 2: The Parent alleged that, since the onset of the 2025-2026 school year and the Student’s placement at the EASTCONN program, the Student has demonstrated school refusal behavior and only attended school for 15 school days total without the District making proper efforts to remediate the Student’s school refusal behavior. (34 CFR § 300.17(d))

Conclusion(s)

Issue 1: It was confirmed that there was interruption to the provision of services to the Student while awaiting an out of district placement for varied reasons (i.e., hospitalization, search for new tutors, and multiple Student school refusals). That interruption was addressed through a PPT determination to provide eighteen 2-hours compensatory services sessions. The District stood ready to provide the agreed-to compensatory services, however the Student initially made himself unavailable for instruction and then the Parent requested that the provision of those services be placed on hold and never recontacted the District to resume the provision of those services. Only two of the eighteen agreed-to sessions of the compensatory education services had been provided and, while the Parent did halt the remaining services, in effect, for the remainder of the summer, she never declined those remaining services. For this reason, the District owed the Student sixteen 2-hour sessions of compensatory services. A corrective action was issued.

Issue 2: The District, in collaboration with the Student’s Parent and the EASTCONN CDT Program, demonstrated a robust measure of strategies to re-engage the Student to address his significantly poor attendance since his placement at the EASTCONN program. This includes consistent communication with the placement and the Parent, multiple convenings of the Student’s PPT, inclusion of a goal with an objective specifically targeted on attendance, virtual check-ins, and the agreement to, twice, provide transportation for the Parent to accompany the Student to school to support his attendance. The District made a good faith effort to address the Student’s attendance issues. It was strongly recommended that significant efforts continue in addressing the Student’s attendance (e.g., reconsider conducting an FBA, consider offering in-home (or at the library) counseling services, and other such activities designed to support the Student in improved attendance). No corrective actions were issued.

Corrective Action(s)

  1. On or before December 31, 2026, the District shall provide the Student with sixteen 2-hour sessions of compensatory services. Upon delivery of the full measure of services, the District shall inform the State.
