Allegation(s)
- The Parent alleges that despite evidence that the Student was struggling (i.e., attendance issues, communications to the Parent, special education referral by school staff), the District failed to adequately address the Student’s academic, social, emotional, and behavioral needs during the 2025–2026 school year by failing to find her eligible for special education and related services. (34 CFR § 300.111 and RCSA §§ 10-76d-6 and 10-76d-7(c))
Conclusion(s)
- The evidence demonstrates that although the District took various steps during the 2025–2026 school year to monitor and encourage the Student’s attendance, such as convening regular meetings among District staff, frequently contacting the Parents, and making referrals to District programs and outside agencies, these interventions did not yield improved attendance or academic progress. Additionally, although the District submitted a referral for special education for the Student due to attendance concerns, they failed to initiate an evaluation, improperly citing those same attendance concerns as an exclusionary factor. Therefore, the District is in violation of 34 CFR § 300.111 and RCSA §§ 10-76d-6 and 10-76d-7(c). Corrective action will follow.
Corrective Action(s)
- The District must convene a PPT meeting no later than September 15, 2026, to discuss and explore all of the Student’s needs and develop a comprehensive initial evaluation.
- The District is required to provide training to all PPT members who are school employees on legal requirements under 34 CFR § 300.111 and RCSA §§ 10-76d-6 and 10-76d-7(c), including obligations under child find. An agenda for the training, along with a list of attendees, must be submitted to this office. The training must be completed no later than September 30, 2026.
