Allegation(s)

  • The Parent alleges that the District failed to implement the Student’s IEP with fidelity. (34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(3))
  • The Parent reports that from December 2025 – the end of April 2026, data was not collected on the Student’s communication goals and objectives. Additionally, the progress report sent to the Parent on April 15, 2026, reflects the same progress codes as reported on December 1, 2025, progress report. (34 CFR § 300.320 (a)(3)(i))

Conclusion(s)

  • According to the Student’s IEP developed on October 3, 2025, the Student was to receive language/communication services once per week for 30 minutes in a small group with a speech and language pathologist in a general education setting with 50% or more non-disabled peers. The Student was also to receive language/communication services once per week for 30 minutes individually with a speech and language pathologist in a related service setting. Finally, the Student was to receive language/communication services once per week for 30 minutes in a small group with a speech and language pathologist in a related service setting. In December, the Student’s regular speech and language pathologist went out on medical leave. She did not return to the District until March, when she only worked for one week before leaving again. Another speech and language therapist filled in while the District attempted to locate a replacement. The District kept track of missed services. To address the missed services, when the April PPT changed service delivery to twice per week, the Student maintained a schedule of 3 sessions per week to make up the missed speech and language services. Following the end of the school year, and accounting for additional days that were missed due to staff illness and school activities such as testing, there were a remaining 8 sessions to be made up upon return in the fall of 2026. Therefore, the District is in violation of 34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(1). Corrective action is required.
  • In this case, the District failed to collect the necessary data to monitor the Student’s progress in language and communication, as evidenced by the April 15, 2026 Progress Report noting insufficient data due to a change in therapists and the April 22, 2026 PPT meeting confirming that the SLP who provided services between December 2025 and March 2026 did not collect data on the Student’s goals. Without fidelity of implementation or adequate progress monitoring data, the Student’s unique needs and present levels could not appropriately guide instruction. Therefore, the District is in violation of 34 CFR § 300.320(a)(3)(i). Corrective action is required.

Corrective Action(s)

  • To remedy the District’s failure to provide the Student’s speech and language services in accordance with the IEP, the District must develop and implement a compensatory education plan that ensures the Student receives all remaining missed sessions. This plan must include the delivery of the eight outstanding speech and language service sessions at the start of the 2026–27 academic school year, provided by a qualified speech and language pathologist, in the setting specified in the Student’s IEP. The District must maintain detailed documentation of each compensatory session delivered and submit verification to the Department upon completion. The compensatory education plan must also include ongoing monitoring of the Student’s progress to ensure that the services sufficiently address any loss of skills or regression resulting from the missed sessions.
  • To remedy the District’s failure to collect required progress monitoring data and to ensure the faithful implementation of the Student’s language and communication services, the District will conduct a targeted assessment to evaluate the Student’s current progress on his IEP goals and objectives and to determine whether revisions to the IEP are warranted. This targeted assessment must be completed no later than September 30, 2026, after which the PPT team will review the results and make any necessary adjustments to the Student’s program. The District will submit the completed assessment and a summary of the PPT’s determinations.
