Allegation(s)

The Advocate alleges that on February 25, 2026, after the Parents submitted a comprehensive records request to the District that explicitly included “all data used to inform progress reports and IEP goals,” the District failed to produce the requested raw data, teacher notes, and progress monitoring data. The Advocate further alleges that the records remained incomplete even after the partial production provided on April 7, 2026. (34 CFR §§ 300.501(a), 300.613(a), and RCSA § 10-76d-18)

The Advocate alleges that the District’s failure to maintain and provide progress monitoring data on the Student’s IEP goals and objectives both in response to the comprehensive records request and at the planning and placement team (PPT) meeting on March 30, 2026, resulted in the misrepresentation of the Student’s progress and adversely affected the Parents’ ability to participate in the meeting. (34 CFR §§ 300.320(a)(3)(i), 300.324(a)(1), and 300.501(b)(1))

Conclusion(s)

The District responded to the Parent’s comprehensive record request on March 5, 2026, which was within five days of the initial request; however, the response was incomplete, as noted within findings of fact #6. As the District did not satisfy the request until March 26, 2026, allowing twenty days to elapse rather than the requirement of no more than ten days, the District is in violation of 34 CFR §§ 300.501(a), 300.613(a), and RCSA § 10-76d-18. Corrective action will follow.

As noted in finding of fact #11, the Student’s IEP required quarterly progress monitoring for the Student’s writing, social/emotional, and transition goals and objectives, and monthly progress monitoring for the executive functioning goals and objectives. The District provided limited evidence of ongoing progress monitoring, as reflected in findings of fact #16 and 17. Although quarterly progress was documented through progress reports, there was no evidence of monthly progress reporting in either the District’s response to the inquiry letter or in the “Progress Data/Notes” sections of the Student’s progress reports. Additionally, much of the submitted documentation failed to align with the stated evaluation criteria and methods of measurement (for example, and objective requiring data “across 5 writing assignments” when only one completed writing assignment was provided, or and objective requiring the Student to “identify and articulate at least 3 personal strengths and 3 areas of need related to his learning in 4/5 trials” when no strengths, needs, or trials were documented). The progress data/notes included in the quarterly progress reports also did not explicitly denote assignments, opportunities, assessments, trials, or percentages. As the District was unable to provide any systemically tracked progress monitoring data or demonstrate evidence of progress monitoring through the provision of quantifiable data on the Student’s progress reports, the District is in violation of 34 CFR § 300.320(a)(3)(i). Corrective action will follow.

The District’s steps outlined in findings of fact #18 indicate their efforts to taken into account the concerns of the Parent. Therefore, the District is not in violation of 34 CFR § 300.324(a)(1). No correction action will be issued.

Additionally, the District’s failure to provide quantifiable evidence of the Student’s performance on goals and objectives hindered the Parent’s ability to participate in the PPT meeting, in violation of 34 CFR § 300.501(b)(1). Correction action will follow.

Corrective Action(s)

  • The District is required to issue a memorandum to all relevant members of the school-based team, to include administrators, special education staff and administrative assistants on the laws and regulations relating to parent rights to inspect and review any education records relating to their child which are collected, maintained or used by the board of education involving requests for access to educational records. A copy of this communication must be submitted to this office no later than September 15, 2026.
  • The District is required to provide training to all PPT members who are school employees on progress monitoring and progress reporting. This training may be incorporated into regular staff professional development. An agenda for the training, along with a list of attendees, must be submitted to this office. The training must be completed no later than September 30, 2026.
