Allegation(s)

Issue: The Parent alleges that beginning in December 2025 and continuing through the filing of the complaint, the District failed to provide the speech and language services included in the Student’s IEP. (34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(3))

Conclusion(s)

A school district must implement a student’s IEP and all of its required components, including related services. Staffing shortages do not excuse this obligation under IDEA. Here, while the District tried to mitigate its failure to provide daily speech and language services to the Student by reassigning an SLP to provide services twice a week, the Student still did not receive a significant number of speech sessions over several months. It is concluded the District violated the IDEA when it failed to provide speech therapy session to the Student on 49 days from December 4, 2025, to April 13 when the Parent declined IEP mandated speech services. The missed days include both the 30-minute group sessions and 20-minute individual sessions. No conclusion is reached that the District failed to implement the IEP after April because the Parent declined IEP mandated speech services.

Corrective Action(s)

  1. Prior to the start of the 2026-2027 school year, the District must provide 26 speech and language therapy sessions to the Student, some of which must be group sessions. This office must be provided an accounting of the services provided at the end of July and the end of August. Further corrective action may follow.
