Allegation(s)
Issue: The Parent claims the District failed to provide the Student with the special education and related services, as well as supplementary aids and services, as outlined in his IEP. Specifically, the Parent claims the District did not implement the Student’s annual goal 40 during the months of February 2026 and March 2026. (34 CFR §§ 300.323(c)(2) and 300.17(d) and RCSA § 10-76d-1(a)(1) and RCSA § 10-76d-19(a))
Conclusion(s)
Skills targeted by Goal 40 were worked on at least on some days in February and March. It is not possible to determine if the Student had an opportunity to make a choice as to what entrée he wanted on March 10. The Student did have an opportunity to carry his lunch tray from the serving area to the cafeteria table on March 10. Annual Goal 40 sets forth a goal that, under certain circumstances, and with appropriate instruction and support, the Student would be able to make a choice in the lunch line, use his card to pay and carry his tray to his seat. In order to master this goal, the Student needed instruction and support and an opportunity to practice applying the instruction. A goal statement is different from the statement of the special education service in a student’s IEP. The description of services includes the frequency at which the service must be delivered (e.g. how many times a week) and the duration of the service. This Student’s IEP includes daily living skills instruction to be implemented three times a week. It is not a failure to implement an IEP goal because the goal is not addressed every day. In contrast, if a service is not provided according to the IEP, that failure is a violation of the IEP. So, if, in fact, the Student was not given instruction or support or an opportunity to practice the skills targeted by Goal 40 on one day, that does not amount to a failure to implement the goal in violation of IDEA requirements and is not a denial of a free appropriate public education. The Student’s PPT will need to review the Student’s IEP in light of the fact that the Student failed to master Goal 40 as the team expected the Student to have been able to master with the IEP services provided. No violation is found and no corrective action is required.
