Allegation(s)

  • The Attorney alleged that the District failed to convene a PPT, which the District itself insisted was necessary but which it failed to schedule.(34 CFR § 300.324)

Conclusion(s)

  • The District developed a draft IEP in June 2025.However, the Parent did not sign consent following the development of the Student’s IEP and therefore was treated as parental refusal of consent. In November 2025, the Parent’s Attorney emailed the District’s Attorney and stated that the Student had stabilized and was prepared to proceed with testing.The District’s Attorney responded that the PPT needed to reconvene to get an update on the Student’s status and to discuss appropriate testing.The Parent’s Attorney and the Parent were waiting to hear from the District’s Attorney, but they never did until April 2, 2026.The meeting to determine the Student’s eligibility for special education and related services was scheduled 77 days after it was initially requested.Although the Student had been found eligible less than a year prior, the Parent never signed consent for services.When the Parent’s Attorney requested that the Student be evaluated, nothing was scheduled for well beyond 45 days.Therefore, there is no violation of 34 CFR § 300.324 since the Parent never consented to services.However, the District is in violation of RCSA 10-76d-13(a)(1) which states that the individualized education program shall be implemented within forty-five days of referral or notice, exclusive of the time required to obtain parental consent. Corrective action required.

Corrective Action(s)

  • The District must review with the staff members on the Student’s team who were responsible for scheduling PPT meetings the 45-day timeline for an initial evaluation in accordance with RCSA §10-76d-13 and review the District’s suggested timeline for staff to reach out to Parents prior to required PPT meeting dates to ensure that the PPT meetings are scheduled in accordance with the required timelines. This review could be part of professional development.An outline of the review including staff signatures and date must be sent to this investigator no later than September 15, 2026.
