Allegation(s):
Issue: The Parent alleged that the Student was denied entry to the Discovery Room when she was having an anxiety episode. The Student was denied entry by the staff monitoring the Discovery Room and then went to her case manager’s room and was denied entry to that room by her case manager. The Parent alleged that the Student’s behavior escalated due to her being turned away twice from places to which her IEP required she have access during such episodes. (34 CFR § 300.17(d))
Conclusion(s):
According to the requirements and supports in place of the Student’s IEP, staff accurately and appropriately offered the Student the planned options to address her behavior. It was concluded that the District was not out of compliance with 34 CFR § 300.17(d) and no corrective actions were issued.
