Allegation(s)
- The Parent alleges that the District failed to provide supplementary aids and services as required per the Student’s individualized education program (IEP) during the 2025-2026 school year; specifically, “access to speech to text software for all classes and activities as needed”, “preferential seating”, and “access to assistive technology” (34 CFR §§ 300.323(c)(2), 300.17, and RCSA § 10-76d-1(a)(1)).
Conclusion(s)
- While not originally an issue outlined in the inquiry letter, it was discovered during the course of the investigation that the District did not provide any progress reports for the Student during the 2025-2026 school year. The District was provided the opportunity to respond to this concern but was unable to provide a rationale. Therefore, the District is in violation of 34 CFR §§ 300.320(a)(3). Corrective action will follow.
- The Student’s IEP does not specify Read&Write, but the District stated that Read&Write is their chosen platform for the provision of the speech to text, and access to other assistive technology as required per the Student’s IEP. The District’s failure to ensure that licenses were appropriately procured resulted in the Student not having access to all supplementary aids and services as required per their IEP during the 2025-2026 school year. Therefore, the District is in violation of 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1). Corrective action will follow.
Corrective Action(s)
- The District is required to provide training to all PPT members who are school employees on progress monitoring and progress reporting. This training may be incorporated into regular staff professional development. An agenda for the training, along with a list of attendees, must be submitted to this office. The training must be completed no later than September 30, 2026.
- The District must provide proof of the Student’s ability, for the 2026-2027 school year, to access all supplementary aids and services as listed on their IEP by September 1, 2026. This may include a current Read&Write license. Should this not be provided, the District will ensure that all assignments and assessments requiring assistive technology are subject to re-test by the Student, with the required supplementary aids and services in place.
