Allegation(s):
- Issue 1: The Parent alleged that the Student’s BIP was not implemented with fidelity. (34 CFR § 300.17(d))
- Issue 2: The Parent alleged that the provision of a 1:1 paraeducator to the Student was included in the Student’s IEP without appropriate reason. The Parent also alleged that there was no documented plan to fade the Student’s 1:1 paraeducator support. (34 CFR § 300.114)
Conclusion(s):
- As related to Issue 1, a review of the evidence submitted indicated in all cases that the District implemented the Student’s BIP with fidelity. It was concluded that the District was not out of compliance with 34 CFR § 300.17(d). No corrective actions were issued.
- As related to Issue 2, a review of the evidence related to the basis of the provision of the adult support at the 1:1 level indicated that such level of service was appropriate and ongoing methods were in place to periodically re-evaluate when and if that level of support could be reduced.
