Allegation(s)
The Parent alleged that the District failed to consistently provide supplementary aids and services to the Student as required per their individualized education program (IEP) for the time period beginning January 5, 2026, through May 5, 2026. (34 CFR §§ 300.323(c)(2), 300.17, and RCSA § 10-76d-1(a)(1)).
Conclusion(s)
The District admittedly failed to provide, or furnish evidence of having provided, the required supplementary aids and services to the Student. As a result, the District is in violation of 34 CFR §§ 300.323(c)(2) and 300.17, and RCSA § 10-76d-1(a)(1). The direct impact of this failure on the Student’s academic performance, specifically math and English as reported by the Parent, and on the Student’s progress on IEP goals and objectives is difficult to ascertain. The Student’s English grade increased in quarter 2 and then decreased in quarter 3, remaining generally consistent with the grade from quarter 1. The Student’s math grade remained steady in quarters 1 and 2 and then increased in quarter 3. Progress on IEP goals and objectives indicate that the Student’s performance experienced a slight decrease since April 2025 but then rebounded. However, this pattern is especially concerning because the PPT had set goals and objectives that the Student had essentially already mastered, yet the Student made negligible progress over the course of the entire year. Therefore, corrective action and recommendations will follow.
Corrective Action(s)
- The District is required to issue a memorandum to all relevant members of the school-based team, to include administrators and special education staff on the laws and regulations of 34 CFR §§ 300.323(c)(2) and 300.17(d) and RCSA § 10-76d-1(a)(1) as they relate to the implementation of IEP supplementary aids and services. A copy of the information included in the review and staff signatures must be provided on or before September 15, 2026.
- The District is required to reconvene a PPT meeting to discuss and explicitly outline each of the Student’s supplementary aids and service needs to ensure implementation fidelity moving forward. The PPT meeting should be held on or before October 1, 2026.
Recommendations
The District should reconvene to revise IEPs in instances where documented progress fails to align with evaluation criteria and methods of measurement (for example, an objective requiring a percentage, but then listing progress data in terms of trials, or failing to provide any baseline). Furthermore, the District should convene PPT meetings not just to discuss progress, but to revise goals where objectives are mastered or when expected progress is not being made across all areas as required under 34 CFR §§ 300.324(b)(1).
