Allegation(s)
34 CFR § 300.304(c)(4), § 300.304(c)(6), § 300.304(b)(1), and RCSA §10-76d-9(a) failure to conduct evaluations of a child that are sufficiently comprehensive to identify all of the child's special education and related services needs, whether or not commonly linked to the disability category in which the child has been classified. Additionally, in conducting the evaluation, the public agency must, (1) Use a variety of assessment tools and strategies to gather relevant functional, developmental, and academic information about the child, including information provided by the parent.
Conclusion(s)
The initial evaluation used to determine that the Student was eligible for occupational therapy services following the review of the IEE at the PPT at the PPT meeting on November 22, 2024, was again used to determine ineligibility at the May 2, 2025, PPT meeting. Additionally, clinical observations and mastery of the Student's goal and objectives were taken into consideration. It is determined that the District used a variety of assessment tools and strategies to provide sufficiently comprehensive information related to the Student's fine motor needs, as documented in the PWN, and therefore is not in violation of 34 CFR § 300.304(c)(4), § 300.304(c)(6), § 300.304(b)(1), and RCSA §10-76d-9(a).
