Allegation(s)
- The Surrogate Parent alleges that at a planning and placement team (PPT) meeting on June 5, 2026, the District stated that the Student would be re-assigned to a more restrictive placement starting June 8, 2026, but failed to provide prior written notice. (34 CFR § 300.503(b)(7) and RCSA § 10-76d-8(a))
Conclusion(s)
- The District did not document their proposed action of changing the Student’s placement to a more restrictive setting starting June 8, 2026, through PWN nor did the Surrogate Parent agree to waive the required 10-day waiting period for the proposed action to take effect. Therefore, the District is in violation of 34 CFR § 300.503(b)(7) and RCSA § 10-76d-8(a). Corrective action will follow.
Corrective Action(s)
- The District will complete an accurate prior written notice that is reflective of the change in placement on or before August 1, 2026.
- The District is required to provide training for individuals involved in this case on the laws and regulations relating to the completion of Prior Written Notice. An agenda for the training, along with a list of attendees, must be submitted to this office. The training must be completed no later than September 15, 2026.
