Allegation(s)

  • The Attorney alleges that the District failed to provide the Student access to medical homebound instruction. (RCSA § 10-76d-15)

Conclusion(s)

  • In this case, the District had been providing medical homebound instruction through April 14, 2026, and the documentation submitted met the regulatory standard for medical verification. Rather than continuing instruction while seeking clarification or initiating a review consistent with RCSA § 10-76d-15(d), the District suspended homebound instruction on April 14, 2026, and indicated it would contact the student’s physician afterward. If the District did not have consent to speak with the Student’s medical provider, then the District should have requested it from the Parent. However, there is no evidence that the Parent was refusing to provide consent considering she had consistently submitted the required documentation in the past. The District’s action was inconsistent with state regulatory requirements and resulted in a disruption of services to which the student was entitled.

Accordingly, the District violated RCSA § 10-76d-15. Corrective action is required

Corrective Action(s)

  • The District must provide the Student with 6 weeks at 5 hours per week (Total of 30 hours) of compensatory education to make up for the District’s failure to meet its medical homebound instruction obligation. With input from the Parent and the Parent’s Attorney, the District must develop a plan, no later than August 14, 2026, to provide compensatory education services to the Student. The services can be provided by District staff or through a contract agency. If the District, the Parent, and her Attorney cannot agree on the plan, this office will determine the compensatory education.
  • In addition, the District must provide targeted training to relevant administrators, case managers, and health services personnel on continuum and placement requirements, medical homebound instruction, and procedures for handling disputed medical documentation (including the requirement to continue instruction pending review). The training can occur as a part of a scheduled professional development. The training must be completed by October 15, 2026. A sign-in sheet from the training must be submitted to this office.
