Allegation(s)

The Parent alleged that on January 13, 2026, the Student’s PPT revised the Student’s IEP to include 1:1 paraeducator support for instruction and behavior and that support was not provided to the Student. (34 CFR § 300.17(d)).

Conclusion(s)

The District acknowledged that from January 13, 2026, through April 20, 2026, the Student’s 1:1 paraeducator, which was added to his IEP in order to support his academic progress and support his school behavior, was not provided. An examination of the Student’s progress on his IEP goals and objectives associated with that timeframe reveals that, in the academic areas of Reading and Math, the Student was only making satisfactory progress on 1 of 9 total objectives. In the social/emotional skills/behavioral area, the Student was not making satisfactory progress on either of his 2 objectives. Further, the log describing the Student’s behavior during the same timeframe indicates that the Student was displaying disruptive and unsafe behavior. This investigator finds a high correlation between the Student’s lack of academic/behavioral progress, together with disruptive and unsafe behavioral events, and the absence of his required 1:1 adult support, which had been included in the IEP in order to support those same areas. Thus, the lack of provision of the Student’s 1:1 paraeducator had significant impact on the Student’s ability to succeed and progress in his school environment. It was concluded that the District was not in compliance with 34 CFR § 300.17(d) and corrective action were issued.

Corrective Action(s)

  • Based on the impact of the absence of the 1:1 paraeducator on the Student’s ability to progress both academically and behaviorally, the District shall provide the Student with compensatory services in the areas of reading, math and social/emotional skills in the total amount of 25 hours, to be delivered in full no later than November 30, 2026.
  • The scheduling, frequency and duration of compensatory service sessions shall be mutually agreed upon between the District and the Parent.
  • Upon full completion of the compensatory services, the District shall inform the State.
