Allegation(s)
According to the Administrator, the District failed to have an individual present at the May 12, 2025, PPT meeting who could interpret the instructional implications of evaluation results. (34 CFR § 300.321 and RCSA § 10-76d-10)
Conclusion(s)
The District was in compliance with the required team members which included the Parent, a general education teacher, a special education teacher, and a District administrator, which met the requirements under 34 CFR 300.321 (4)(i-iii). In addition, the special education teacher and/or the District administrator did in fact satisfy the requirement of an individual who can interpret the instructional implications of evaluation results. Therefore, it is concluded that the District complied with 34 CFR § 300.321 and RCSA § 10-76d-10 on May 12, 2025, by convening a PPT that met federal and state requirements in terms of team membership and ability to make decisions regarding the student’s education program. No violation is found and no corrective action is required.
