Allegation(s)

The Parent alleged that despite the Parent’s contention that the Student had suspected disabilities that included deficits in spelling, math computation, and executive functioning the District failed to sufficiently assess the Student in these areas, which resulted in a determination that the Student was not eligible for special education services. (34 CFR § 300.304(c)(6))

Conclusion(s)

34 CFR § 300.304(c)(6) requires that an LEA must ensure that the student is assessed in all areas related to the suspected disability, if appropriate, health, vision, hearing, social and emotional status, general intelligence, academic performance, communicative status and motor abilities.

Based on a review of the Student’s records, the Student was sufficiently assessed in the areas of suspected disability suggested by his Parent (i.e., spelling, mathematics, executive functioning). The evaluation met the requirements of 34 CFR § 300.304(c)(6). It was concluded that the District was not out of compliance. No corrective actions were issued.
