Allegations:

The Parent alleged that the District has failed to provide the Student with the services in his IEP since the start of the 2025-26 school year.  The Parent did not sign consent for the initial provision of special education and related services until December 22, 2025, and therefore did not have a right to special education services until that date.  The school was on winter break from December 22 through January 2.  Since the complaint was filed on January 6, 2026, the complaint investigation will only address the implementation allegation for January 5, 2026, and January 6, 2026. (34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1))

Conclusions:

34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1) require each board of education to provide in a timely way special education and related services in accordance with the student’s individualized education program.  The records reviewed for this complaint investigation demonstrate that the Charter school implemented the Student’s IEP on January 6, 2026.  Even though the IEP provides for behavior consultation once a month, the Charter school did not have to provide that consultation on January 6, 2026, and had the remainder of the month to implement this part of the IEP.  No violation of 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1) is found and no corrective action is required.
