Allegation(s):

  • Failure to provide the opportunity for the Parents of the Student to participate in meetings with respect to (i) The identification, evaluation, and educational placement of the child; and (ii) The provision of FAPE to the child. (2) Each public agency must provide notice consistent with § 300.322(a)(1) and (b)(1) to ensure that parents of children with disabilities have the opportunity to participate in meetings. (3) A meeting does not include informal or unscheduled conversations involving public agency personnel and conversations on issues such as teaching methodology, lesson plans, or coordination of service provision. A meeting also does not include preparatory activities that public agency personnel engage in to develop a proposal or response to a parent proposal that will be discussed at a later meeting (34 CFR § 300.501 (b) (1))
  • Failure to include an updated statement of the Student’s present levels of academic achievement and functional performance and a statement of measurable annual goals, including academic and functional goals on the Student’s IEP (34 CFR § 300.320(a)(1))

Conclusion(s):

  • The District is not in violation of 34 CFR § 300.501 (b) (1) for the following reasons. The Parent had the opportunity to disagree with the recommendations. The Parent’s disagreements of the recommendations were noted in the IEP. The District revised the IEP to align with the District’s practice of having the special education teacher and transition coordinator determine transition assessment tools. The documentation (IEP and prior written notice) from the previous PPT meeting, indicates the Parent’s participation in the Student’s transition planning. The adjustments to the goals were made by the special education supervisor at the PPT meeting. The transition service was added to reflect the revised transition goals and change of service implementer. The District is not required to agree with the Parent in order for the Parent to be an equal participant of the PPT. The District made the Parent aware of their rights under the procedural safeguards if they disagreed with the recommendations made by the District.
  • The Student’s present levels of performance in the goal areas of other (academic), fine motor, other (functional), and social emotional were not updated in the IEP within the last year. There have been multiple PPT meetings in which the Student’s present level of performance in those goal areas should have been updated. It is concluded that the District is in violation of 34 CFR § 300.320(a)(1) due to the lack of current and updated information in the Student’s present levels of academic achievement and functional performance.

Corrective Action(s):

  • A PPT meeting must be convened to review/revise the Student’ IEP to update the present levels of performance for the goal areas of other (academic), fine motor, other (functional), and social emotional to satisfy the requirements of 34 CFR § 300.320(a)(1). The District must provide documentation to the CSDE on or before May 25, 2025.
