Allegation(s):

  • 34 CFR § 300.311(c)(1) and 34 CFR § 300.17(d) failure to provide the definition of a school day, and failure to provide FAPE in conformity with an IEP.
  • Conn. Gen. Stat. § 10-220m. failure to review the transportation arrangements of their special needs students and make the appropriate changes to ensure the safe transportation of the students, which may involve placing school bus monitors or cameras on the vehicles used for such transportation.

Conclusion(s):

  • District is in violation of 34 CFR § 300.311(c)(1) due to missed instructional time because of District transportation issues.
  • District is not in violation of Conn. Gen. Stat. § 10-220m, due to no substantiated safety concerns.

Corrective Action(s):

  • District will ensure that the Student, when in attendance, remains in the school building for the entire duration of their instructional time and will maintain daily documentation of the Student’s initial entrance to and final exit from the building
  • District will increase the Student’s in-school attendance from three to four days per week, for a set period of time, to compensate for missed access to individualized instruction and related services.
