The Attorney alleged that the Students attending the Charter School were not provided with the special education and related services in accordance with their individualized education programs (IEPs) from August 27, 2024, through January 27, 2025. 34 CFR §§ 300.323(c)(2) and 300.17 and RCSA § 10-76d-1(a)(1)

The District’s tracking of the delivery of these missed services was unclear to these investigators despite repeated requests. The District provided staff schedules as their evidence of the delivery of missed services.
Corrective Action(s):
- The District is required to provide compensatory services for each of the Students identified in this complaint for the missed special education and related services outlined in the conclusions above. The provision of compensatory education shall occur under terms mutually agreed upon by the Parents and the District. If the District and the Parents encounter a disagreement about the scheduling of services, the District shall contact this office and this investigator will decide. The Parents may decline the offer of compensatory education in whole or in part. Given the amount of time that has passed since the time period of the investigation, the District must provide a detailed description of the current status for each of the Students identified in this systemic state complaint in the form of a spreadsheet. The spreadsheet must include the columns below for all ten Students in this complaint. The column titled Special Education Services (List Individually) and Service Hours Missed must use the data identified in the table above in the Conclusions section of this findings letter. Supporting documentation of the delivery of services must be included. The completed spreadsheet must be provided to these investigators beginning on January 2, 2026, on a monthly basis until the CSDE can confirm the full delivery of the missed services. All compensatory education services must be provided in full by June 30, 2026.
- The District must provide the CSDE with a detailed spreadsheet for the 62 special education students attending the Charter School from August 27, 2024, through January 27, 2025. The spreadsheet must include the columns of information identified below and identify each special education and/or related service in accordance with the Student’s active IEP(s) during the identified timeframe and the status of delivery of those services. This spreadsheet must be provided to these investigators on or before January 2, 2026. All compensatory education services must be provided in full by June 30, 2026.
