Allegation(s):

  • The complainant alleges that the Student is not being provided the special education and related services in compliance with her individualized education program (IEP) (34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1)).

Conclusion(s):

  • In a letter dated June 28, 2024, the District informed the Charter School that the District was assuming the responsibilities of ensuring that the services at the Charter School were provided as mandated by the students’ IEPs. Subsequent staffing issues led to the lack of IEP services being provided to the Student and despite the District’s efforts to fill the positions at the Charter School, the District is in violation of 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1). Corrective action is required.

Corrective Action(s):

  1. The District must provide the Student with a compensatory education plan in the area of reading and counseling. A log must be kept of each individual service and include the date, time, length of session, service provider, and focus of the session. The CSDE must receive monthly updates on the completion of the compensatory education services beginning on January 30, 2025. The monthly logs must be sent to this investigator. All compensatory education services must be completed by June 30, 2025. Specific hours are as follows:
    1. 1050 minutes (or 17.5 hours) of reading instruction in site 2a/resource setting
    2. 120 minutes (or 2 hours) of counseling in site 2c/related services setting This complaint and substantiated violation will be referred to the Differentiated Monitoring and Supervision Team at the Connecticut State Department of Education for further consideration and action, as appropriate.
