Allegation(s):
- Implementation of IEP (34 CFR § 300.17(d)). The Parent alleges that the Student’s IEP requires that a “back-up” Registered Behavior Therapist (RBT) be provided for the Student during times when the regular RBT is not available and that during those times, the District is required to notify the Parent that the RBT is unavailable to work with the Student.
Conclusion(s):
- Based on a review of the Student’s IEPs and the associated communication plan as related to RBT coverage, the District met the requirements of the IEP. Further, as specifically related to the communication plan for RBT coverage, during the occasion when the communication plan needed to be utilized, it was successful. It was concluded that the District was not out of compliance with 34 CFR § 300.17(d) and no corrective action was issued.
