Allegation(s):
- 34 CFR § 300.322(a) and RCSA §10-76d-12(a): Failure to ensure that one or both of the parents of a child with a disability are present at each IEP Team meeting or are afforded the opportunity to participate..
- 34 CFR § 300.9(a) Failure to ensure that the parent is fully informed of all information relevant to the activity for which consent is sought, in his or her native language, or through another mode of communication; (b) The parent understands and agrees in writing to the carrying out of the activity for which his or her consent is sought, and the consent describes that activity and lists the records (if any) that will be released and to whom.
- RCSA §10-76d-18(a)(2) Failure to respond to reasonable requests from the parent to review, inspect and provide explanations and interpretations of the child’s education record.
Conclusion(s):
- The District was not in violation of 34 CFR § 300.322(a) and RCSA §10-76d-12(a) as records indicate they took the requisite steps to ensure that the parent was afforded the opportunity to participate.
- The District is in violation of 34 CFR § 300.9(a) due to the parent’s absence from a PPT meeting, they did not fully understand the activity (proposed evaluations) for which their consent was sought.
Corrective Action(s):
- The District will schedule and hold, at a mutually agreeable time, an informal meeting or phone call with the parent to explain the proposed evaluations, including their length, and why the District believes that these evaluations are appropriate for the Student.
