Allegation(s):
- Failure to provide special education and related services in conformity with the Student’s IEP (34 CFR § 300.17(d))
Conclusion(s):
- The District is not in violation of 34 CFR § 300.17(d). The Student’s IEP from the PPT meeting held on April 22, 2025, states that the counseling group is implemented by a guidance counselor in the general education setting. The District set a plan to provide the Student with group counseling, including the name of the guidance counselor who will provide the services, when the group will take place, the group of students selected to be part of the counseling group, and where the group will meet. The Parent emailed the District stating that she does not agree with the service provider because the guidance counselor. The Parent also emailed the District stating that she does not agree with the students selected to be part of the counseling group. The District responded to the Parent stating that they are working to find another service provider. From the start date on the IEP to the date the complaint was filed, the Student missed three sessions.
- The District made available and was prepared to provide the group counseling service to the Student on the start date of the service, but at the Parent’s request, did not proceed with the service with the assigned guidance counselor. The District made the service available and ready to be provided to the Student at the start date of the service.
