Allegation(s):

  • 34 CFR § 300.501(a) failure to afford the parents of a child with a disability, in accordance with the procedures of §§300.613 through 300.621, an opportunity to inspect and review all education records with respect to (1) the identification, evaluation, and educational placement of the child; and (2) the provision of FAPE to the child. Additionally, 34 CFR § 300.501 (b)(1) states that the parents of a child with a disability must be afforded an opportunity to participate in meetings with respect to (i) the identification, evaluation, and educational placement of the child; and (ii) the provision of FAPE to the child.
  • 34 CFR § 300.320(a)(2)(i) failure to ensure that an individualized education program or IEP includes a statement of measurable annual goals, including academic and functional goals designed to (A) meet the child’s needs that result from the child’s disability to enable the child to be involved in and make progress in the general education curriculum.

Conclusion(s):

  • The District is in violation of 34 CFR § 300.501(a) and 34 CFR § 300.501(b)(1) because the parent was not provided with all information requisite to being able to meaningfully participate in the student’s PPT meeting.
  • The District is in violation of 34 CFR § 300.320(a)(2)(i) in terms of providing measurable goals but not related to the Student’s progress in the general education curriculum

Corrective Action(s):

  • The District is required to provide training on writing measurable goals and objectives, progress monitoring, and progress reporting.
