Allegation(s):
- Failure to provide special education and related services in conformity with an individual education program (IEP) (34 CFR § 300.17(d))
Conclusion(s):
- The case manager sent an email to the Student’s teacher with all accommodations in the Student’s IEP. The case manager held a meeting to review the accommodations in the Student’s IEP. When the IEP was revised, the case manager hand delivered a copy of the new IEP to the teacher and reviewed the new accommodations. The District has provided an example in which the accommodation of “alternative setting for tests and quizzes” have been provided to the Student in class. The District indicated that the accommodation for “open access to school social work or school psychologist” was not used by the Student in class. For quarter 1 and 2, the Student received an average of 85% in the class. Since the start of this investigation, the District indicated that they have reviewed all Students’ IEPs with the teacher, including the Student’s IEP from this investigation.
- Although the District has indicated that Students’ IEPs and accommodations were reviewed with the teacher, there are instances where the accommodations of “utilize a neutral tone when providing corrective feedback or reassurance when the Student has a question”, or “offer collaborative problem solving in times of inflexible thinking” was not provided to the Student in class. The BSE acknowledges the efforts the District has made to review all students’ IEPs, but because of the instances in class where the accommodations of “utilize a neutral tone when providing corrective feedback or reassurance when the Student has a question”, or “offer collaborative problem solving in times of inflexible thinking” was not provided to the Student, the District is in violation of 34 CFR § 300.17(d).
Corrective Action(s):
- The District proactively rectified the violation of 34 CFR § 300.17(d) when the District met with the teacher to review all Students’ IEPs, including the Student specified in this investigation. No further corrective action is required.
