Allegation(s):

  • Issue 1: The Parent alleged that the Student’s right to be provided all IEP services in his LRE were violated in that the District, when participating in the Student’s PPTs, failed to offer for consideration the Student’s access to general education instructional interventions before recommending more restrictive interventions and services. Further, the Parent alleged that the District failed to consider the Student’s participation in the general education environment with the use of supplementary aids and services (e.g., accommodations, modifications, and paraeducator support) before placing him in more restrictive environments. (34 CFR § 300.114)
  • Issue 2: The Parent alleged that the District’s attorney made a false statement in a written response to the State by stating that the reason the Student did not have a particular teacher was because it was a result of a decision to change a class. (34 CFR § 300.618)

Conclusion(s):

  • Issue 1: The District did provide the Student with supplementary aids and services along the LRE continuum prior to recommending the Student for the self-contained ELA classroom. Therefore, it is concluded that the District was compliant with 34 CFR § 300.114 and no corrective action will follow.
  • Issue 2: The statement made by the District’s attorney to which the Parent objects does not meet the criteria as an educational record and, therefore, cannot be petitioned for amendment. Therefore, there is no manner in which such an alleged statement can be addressed through the complaint process. It is concluded that the District did not act in a manner out of compliance with 34 CFR § 300.618 and no corrective action will follow.
