Allegation(s):
- Failure to provide in a timely way special education and related services in accordance with the Student’s IEP (34 CFR Section 300.323(c)(2)) and (34 CFR Section 300.17(d)); (RCSA Section 10-76d-1(a)(1)).
Conclusion(s):
- The District is in violation of 34 CFR Section 300.323(c)(2), 34 CFR Section 300.17(d), or RCSA Section 10-76d-1(a)(1) which requires that special education and related services are provided in a timely way in accordance with the student’s IEP. The Student’s current IEP includes in recommendations and accommodations “Shared paraprofessional in All Classes”. The District did not provide the Student with paraeducator support in all classes in accordance with the Student’s IEP from October 3, 2024 to November 5, 2024. *The District is not in violation with regard to implementing the accommodations in the Student's IEP. The District provided the accommodations to the Student, as written in the IEP, and provided the Parent with the corresponding weekly reports.
Corrective Action(s):
- The District needs to immediately hire a paraeducator and implement Students’ IEPs as written. If the District is unable to hire a paraeducator, they should document their efforts to fill the vacancy. The District should communicate with parents about the vacancy. The District is required to track missed services with regular monitoring and updating and develop individualized plans to make up the missed services. This information must be submitted to the Bureau of Special Education.
