Allegation(s):
- Failing to implement the Student’s Individualized Education Program (IEP) with fidelity 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1).
- Failing to write measurable goals that allowed the PPT team to determine if the Student made progress 34 CFR § 300.320(a)(2).
- Failing to adequately measure progress 34 CFR § 300.320(a)(3).
Conclusion(s):
- The District is not in violation of 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1). The Student’s IEP services were not disrupted by the Student leaving class five minutes early. The Student did not miss any other instructional time during this time. As for the speech and language services, the speech and language pathologist met with the Student 29 times, which exceeds the 25 times articulated in the IEP.
- The District is not in violation of 34 CFR § 300.320(a)(2). the Student’s goals in writing, math, language/communication group, and counseling were based on current data and evaluations. Annual goals were statements that described what the Student could reasonably be expected to accomplish within a 12-month period in the special education program.
- The District is not in violation of 34 CFR § 300.320(a)(3). the Student’s IEP accurately measured progress in the areas of social skills and language/communication. With social skills, the special education teacher utilized work samples and personal notes to track the Student’s progress consistent with the criteria documented in the IEP. While with language and communication, the speech language pathologist utilized observational data, narrative retells, work samples and tally sheets to measure progress consistent with the measures documented in the IEP. A report on the Student’s progress was then shared with her Parents consistent with general education grade-level report cards.
