Allegation(s):

  • Issue 1: Did not require investigation.
  • Issue 2: The Parent alleged that the District refused to allow anyone to attend PPT meetings in the Parent’s place to represent her when the Parent is unable to attend the meeting.
  • Issue 3: Did not require investigation.
  • Issue 4: Regulations of Connecticut State Agencies (RCSA) § 10-76d-18(a)(1-2). Access Rights to Records, states that (a) parents shall have the right to inspect and review any education records relating to their child which are collected, maintained or used by the board of education. The Parent indicated that she was unable to access the Student’s electronic education records and required hard-copy records to be provided to her by the District and that those copies must be provided via US mail rather than through her children to ensure they are received by the Parent. The Parent alleged that the District was not compliant with this accommodation.

Conclusion(s):

  • As related to Issue 2, the District offered accommodations (e.g., telephonic participation, rescheduling, virtual participation) in order to foster the Parent’s participation. Having been unsuccessful, the District indicated that the person attending in the Parent’s place was not authorized to make educational decision on behalf of the Student and, with the Parent’s permission proceeded with the PPT meeting. It was concluded that the District was complaint with regulatory requirements and no corrective actions were issued. As related to Issue 4, the District was not aware that the Parent wished to have education records provided in hard copy. At the point that the District was made aware, they made arrangements with the Parent to provide such materials via US mail in compliance with the Parent’s wishes. It was concluded that the District did not violate RCSA § 10-76d-18(a)(1-2) and therefore no corrective actions are required.
