Allegation(s):
- Failure to revise the IEP, as appropriate, to address (A) any lack of expected progress toward the annual goals and in the general education curriculum; (B) the results of any reevaluation; (C) information about the child provided to, or by, the parents; and (D) the child’s anticipated needs (34 CFR § 300.324(b)(ii))
- Failure to provide prior written notice to the parents of a child with a disability when the district either proposed or refused to initiate or change the identification, evaluation, or educational placement of the child or the provision of a free and appropriate public education (FAPE) to the child (34 CFR § 300.503)
Conclusion(s):
- The District is not in violation of 34 CFR § 300.324(b)(ii). The District has made good efforts during the school year to ensure the Student attends school. Since the onset of the complaint, the District has made additional efforts to ensure the Student attends school. Due to the District’s efforts to ensure the Student attends school, the Student’s progress on IEP objectives, and the Student’s grades for the 2024-2025 school year, the IEP did not need to be revised to address lack of progress towards annual goals and the general education curriculum; the results of any reevaluation; information about the child provided to, or by, the parents; and the child’s anticipated needs.
- The District is not in violation of 34 CFR § 300.503 or RCSA § 10-76d-8. Following the PPT meeting held on January 22, 2025, written notice was provided to the Student and Parent on February 4, 2025, for refusing the Parent's request for a change in placement and refusing the request to initiate an evaluation. The date these actions will take effect is February 28, 2025. The District is not in violation because written notice was provided to the Student and Parent more than ten days before the PPT proposed to make the change.
