Allegation(s):

  • Issue 1: The Parent claims that the Student was not provided the accommodations of visual aids, chunking of assignments, templates, simplified language, and graphic organizers provided to the Student in English in accordance with his IEP. (34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(1))
  • Issue 2: The Parent claims that the District did not provide her with a copy of the Student’s full IEP within 5 school days of the respective Planning and Placement Team (PPT) meeting. (RCSA § 10-76d-13(a)(6))

Conclusion(s):

  • Issue 1: The School provided specific examples and copies of the accommodations provided to the Student in his English class. Despite the lack of available individual work samples, there are multiple emails between the classroom teacher and the case manager regarding the implementation of the accommodations and examples of the accommodations that were provided to the Student as well as the examples of the accommodations that were provided in response to this investigation. It is determined that the District did not violate 34 CFR §§ 300.323(c)(2) and 300.17(d) and RCSA § 10-76d-1(a)(1) as it relates to the implementation of visual aids, chunking of assignments, templates, simplified language, and graphic organizers in English class. No corrective action is required.
  • Issue 2: While extenuating personal circumstances are noted, the District is in violation of RCSA § 10-76d-13(a)(6) for not providing the Parent with a full copy of the IEP within five school days. The Parent has been provided with a full copy of the IEP and the District has re-implemented a tracking system to ensure compliance with IEP finalization. No corrective action is required of the District. In the emails between the District’s liaison and the School’s case manager, there seemed to be confusion on the case manager’s part with regards to the when to enter information into CT-SEDS for the Student’s PPT meetings (Fact #27). See the recommendation below.

  • It is strongly recommended that the School review with the Student’s case manager for the 2024-2025 school year, the timeline requirements of RCSA § 10-76d-13(a)(6) and IEP documentation following a PPT meeting.
