Allegation(s):
- Failing to provide notice when the Student was removed from the general education classroom at the beginning of the 2024-2025 academic school year (34 CFR § 300.503 and RCSA §10-76d-8).
- Failing to provide accommodations for the Student to participate in the general education classroom (34 CFR § 300.42).
Conclusion(s):
- The District is in violation of 34 CFR § 300.503 and RCSA §10-76d-8. The Guardian was not provided with notice when the Student was placed in a self-contained classroom at the beginning of the academic school year. The PPT team should have met and discussed the change in the program with the Guardian at a PPT meeting. However, the Student’s IEP was not changed to show the change in the learning environment.
- The District is in violation of 34 CFR § 300.42. The Guardian brought the issue of 1:1 adult support up at the October 21, 2024 PPT meeting. The Guardian was informed that the District did not believe that the Student required 1:1 support to access the educational program designed by the team, however no data was provided to support their decision. Additionally, following the meeting, the Student was returned to the general education classroom. At the October 21, 2024, PPT meeting, the team agreed to conduct an FBA.
Corrective Action(s):
- The District is to provide training to all members of the Student’s team on PWN and LRE. The trainings could be a part of professional development for staff. An agenda for the trainings and a list of attendees must be submitted to this office.
- As soon as possible but in no case later than January 15, 2025, the District must convene a PPT meeting to review relevant data to determine if the Student requires 1:1 support. Please submit information regarding the PPT meeting to this office.
