Allegation(s):
- The Parent alleged that the transportation as described in the Student’s IEP was not provided from August 29, 2024, through September 6, 2024. (34 CFR § 300.17(d)) The Parent alleged that the Student is a member of a school athletic team and is not being provided with the transportation required by his IEP in order to have equal access to participation on the team. (34 CFR § 300.107) The Parent alleged that the Student’s Algebra II teacher failed to implement the Student’s IEP accommodations with fidelity. (34 CFR § 300.17(d))
Conclusion(s):
- It was concluded that the New Haven magnet school was not compliant with ensuring that all services were provided in conformity with the Student’s IEP, however, due to the de minimis impact and in the knowledge that the issue was almost immediately corrected, no corrective actions were issued. It was concluded that the New Haven magnet school was in compliance with 34 CFR § 300.107 and 34 CFR § 300.17(d) and no corrective action were issued. It was concluded that the New Haven magnet school did not implement the Student’s accommodations with fidelity and was non-compliant with 34 CFR § 300.17(d). Corrective actions were issued.
Corrective Action(s):
- In order to fully implement the IEPs, on or before December 15, 2024, New Haven Public Schools (specifically the magnet school) must ensure that a procedure is in place to identify the students with IEPs that include special transportation and ensure that the special transportation is implemented for each day that the student is enrolled in the magnet school.
- In order to ensure that teachers have the necessary supports to implement the requirements of the IEPs of students whom they instruct, on or before December 15, 2024, New Haven Pubic Schools (specifically the magnet school) must ensure that there is a procedure in place for such teachers to receive assistance and support, as needed, from students’ case managers or other appropriate personnel in the implementation of IEP accommodations.
- On or before December 15, 2024, the District shall submit a written attestation to the State (at jay.brown@ct.gov) that the procedures for correctives actions 1 and 2 above are in place. Such attestations shall be considered sufficient to satisfy the requirements of those corrective actions.
