Allegation(s):
- Issue 1: The Student’s October 16, 2023, IEP required that the Student be provided with 1:1 adult support in all areas. The Parent alleges that the Student has not received such 1:1 support with fidelity while in the Key program in the District. 34 CFR § 300.17(d) requires that special education and related services are provided in conformity with an individualized education program (IEP)
- Issues 2-4: The allegations associated with these issues did not represent potential violations of state or federal special education regulations and were not investigated.
Conclusion(s):
- The Parent alleged that the Student was not provided with 1:1 adult support as required by his IEP. It was clear through investigation that the in-district program did provide the 1:1 adult support required by the Student’s IEP and, in fact, the available support from adults at any given time likely exceeded that required by the IEP in most cases. It is concluded that the District was not out of compliance with 34 CFR § 300.17(d) and no corrective actions were issued.
