• Failing to implement the Student’s behavior intervention plan (BIP) with fidelity 34 CFR § 300.324(a)(2)(i).

Conclusion(s):

• The District is not in violation of 34 CFR § 300.324(a)(2)(i). According to the BIP, the Student is to receive direct instruction in functional communication regarding requesting a break. Breaks are provided with behavior-specific feedback. The feedback is aimed to help the Student request breaks when appropriate, and to not engage in a target behavior (work refusal). The Student has never independently requested a break during instruction.
