Allegation(s):
- The Parent alleged that the District failed to implement the Student's IEP. 34 CFR § 300.17(d) requires that special education and related services are provided in conformity with an individualized education program (IEP).
Conclusion(s):
- The evidence showed that the District failed to provide a 1:1 paraeducator for the Student in accordance with the Student's IEP and failed to implement accommodations and/or modifications in accordance with the Student's IEP.
Corrective Action(s):
- Upon receipt of this report, the District, if not already doing so, shall immediately begin providing the Student with the required 1:1 paraeducator with fidelity in compliance with his IEP.
- The District shall provide materials and/or training to appropriate staff regarding regulatory requirements regarding making changes to a student's IEP, and implementing the accommodations and/or modifications in the Student's IEP.
- The District shall convene a PPT meeting to deliver 2.25 hours of compensatory education to the Student.
