Allegation(s):
- The Parent alleged that the Student’s school, an approved private special education program, a placement made and supported by the District through the PPT process, had been unable to provide the Parent with the Student’s current grade level in math. The Parent indicated that the Student’s content area IEP goals and objectives were not robust enough for the Student. (34 CFR § 300.320(a)(1))
- The Parent alleged that a third-party neuropsychological evaluation was provided to the District prior to the Student’s PPT meeting and that the results were not reviewed in detail for consideration at a PPT meeting. (34 CFR § 300.305(a))
- The Parent alleged that the program being provided to the Student in the Student’s placement did not align with the Student’s capabilities, and was no longer appropriate for the Student based on a third-party neuropsychological evaluation which stated, “a residential educational placement is necessary for [the Student], as it provides all-around supports educationally, socially, emotionally, and behaviorally”. (34 CFR § 300.101)
Conclusion(s):
- As related to Issue 1, the Student’s education records clearly indicated that the District/school had identified the Student’s grade level in Math based on standardized tests and his present levels of performance. It was concluded that the District is in compliance with 34 CFR § 300.320(a)(1) and no corrective actions were issued.
- As related to Issue 2, the Student’s education records and the District’s response itemizing their response to each recommendation clearly indicated that the detailed recommendations of the third-party neuropsychological evaluation were considered by a PPT. It was concluded that the District was in compliance with 34 CFR § 300.305(a) and no corrective actions were issued.
- As related to Issue 3, the District had taken appropriate steps to gather evaluative data on an ongoing basis on the Student’s progress in his placement. Based on that data the Student’s IEP goals and objectives were developed and implemented. The Student was described as being well-adjusted, growing educationally and therapeutically, and on track to earning a high school diploma in that placement. His most recent IEP Progress Report indicated that he was making progress that was more than de minimis, therefore, he was being provided with FAPE in his LRE. The District’s regulatory responsibility with regard to FAPE in the LRE had been met. It was concluded that the District was in compliance with 34 CFR § 300.101 and no corrective actions were issued.
