Allegation(s):
- The Parent alleged that the District failed to provide the Student with FAPE in that they refused the Parent’s request for a functional behavioral assessment (FBA) which led to the development of an IEP which does not adequately address the Student’s behaviors which impacts the Student’s safety. The Parent further alleged that she consented to the administration of sensory motor rating scales on April 8, 2025, which were proposed in order to partially assess the Student’s safety behavior and, at the time that the complaint was filed, the District had not yet conducted such assessments. (34 CFR § 300.101)
Conclusion(s):
- Despite the difference of opinion regarding the specific behaviors of the Student, the Parent’s request for an FBA was originally denied on April 1, 2025 on the basis that the demonstrated behaviors on which the request was made were isolated incidents, not similar in nature. The District did however recommend a sensory evaluation and classroom environment observations by the BCBA, the results of which were shared with the PPT on June 2, 2025. Due to the Parent’s ongoing concerns, the District agreed to conduct a behavioral evaluation. The District also agreed to complete an FBA/BIP if warranted based upon the evaluation. Based on the Student’s most recent IEP progress report, it can be determined that he is making more than de minimus progress, and his IEP has appropriately addressed his behavior having mastered or showed satisfactory progress on 89% of his objectives. Therefore, the District is in compliance with 34 CFR 300.101 No corrective actions are issued.
