Allegation(s):
- Special education and related services have not been provided in a timely way in accordance with the student’s IEP. 34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(3). The proposed program is not the student’s Least Restrictive Environment (LRE). 34 CFR § 300.114 and 34 CFR § 300.116.
Conclusion(s):
- The PPT recommended placement. This recommendation is reflected on the IEP and PWN of the same date. The District was ready and able to implement the IEP, however the Student did not attend the program. Multiple PPTs were convened, and communication was made with the parent regarding the Student’s attendance. Two home visits were offered to support return to school; these visits were declined by the parent. The District did not violate regulations.
Corrective Action(s):
None required. Although there is no corrective action, there is required action to be taken by the District which includes:
- The District shall schedule and hold a PPT to address the absences.
- The Student will be invited to the PPT.
- The District will report back to the CSDE with the plan to determine the root cause of the absences, include any proposed targeted assessments or evaluations, and share all recommendations for how the student will access FAPE and all services within the IEP. The matter was referred to the Bureau of Special Education Differentiated Monitoring and Supervision Team.
