Allegation(s):
- Conn. Gen. Stat. § 10-236b(b) physical restraint was used outside the parameters of an emergency intervention to prevent immediate or imminent injury to the student or to others.
- 34 CFR § 300.324(a)(2) failure of the IEP Team to consider special factors, and in the case of a child whose behavior impedes the child’s learning or that of others, consider the use of positive behavioral interventions and supports, and other strategies, to address that behavior.
Conclusion(s):
- The Program was in compliance with Conn. Gen. Stat. § 10-236b(b) in terms of utilizing a physical restraint, but documentation was not properly completed.
- The Program was not in compliance with 34 CFR § 300.324(a)(2) because the additional positive behavioral interventions and supports, and other strategies, to address that behavior had not been considered when behavior was determined to be a manifestation of the disability, and an FBA was not commissioned.
Corrective Action(s):
- The Program must complete an FBA and BIP.
- The Program will provide training in restraint and seclusion reporting and documentation for all PMT certified staff.
- The Program must provide training on the requirements of the manifestation determination process, including all requirements following a determination that behavior was a manifestation of a student’s disability.
