Allegation(s):
- Issue 1: The Parent presented an allegation which did not represent a potential violation of State or federal special education regulations and could not be investigated thorough the complaint process. The Parent was referred to the US Office of Civil Rights (OCR) should they wish to pursue the allegation further.
- Issue 2: The Parent alleged that after the Student’s December 19, 2024, PPT meeting it was noted that a change had been made to the IEP (i.e., 1:1 paraeducator instructional / behavioral support in all classes had been removed) without discussion by the PPT. 34 CFR § 300.324 requires that a PPT develop, review and revise an IEP.
Conclusion(s):
- It was concluded that the change to the IEP was made as an omission/error, but did take place without any PPT discussion, therefore the District was non-compliant with 34 CFR § 300.324.
Corrective Action(s):
- The District shall reinstate the Student’s 1:1 paraeducator support on the Student’s IEP at the same capacities as were in place in the IEP prior to the omission of that support. Such reinstatement shall be effective retroactively.
