Allegation(s):
- 34 CFR § 300.613(a) failure to permit parents to inspect and review any education records relating to their children that are collected, maintained, or used by the agency under this part. The agency must comply with a request without unnecessary delay and before any meeting regarding an IEP, or any hearing pursuant to §300.507 or §§300.530 through 300.532, or resolution session pursuant to §300.510, and in no case more than 45 days after the request has been made.
- RCSA §10-76d-12(a)(1) failure to advise parents in writing, at least five days prior to the meeting, in their native language, of their rights to be participating members of the planning and placement team and (2) Such notice shall also specify the purpose, time and location of the meeting and who has been invited.
- RCSA §10-76d-13(a)(6) failure to provide a full copy of the individualized education program (IEP) to the parents within five days after the planning and placement team (PPT) meeting to develop, review or revise the individualized education program.
Conclusion(s):
- The District was in violation of 34 CFR § 300.613(a) and Sec. 10-76d-18(a)(1) because the board of education did not comply with the request to review and inspect the child’s education records without unnecessary delay.
- The District is in violation of RCSA §10-76d-12(a)(1) because the written notices of meetings contained errors on the invitee list and failed to meet the required five-day notice period. The District is in violation of RCSA §10-76d-13(a)(6) as they exceeded the five-day timeframe when providing a full copy of the IEP.
Corrective Action(s):
- The District is required to provide training on the legal requirements related to the provision of educational records, PPT membership, the proper completion of documentation concerning PPT attendance, and the timelines for the provision of required documentation.
