Allegation(s):
- Failure to provide a free appropriate public education (FAPE) to the Student by offering an IEP that is reasonably calculated to enable the Student to make progress that is more than de minimis and is appropriate in the light of the Student’s circumstances (34 CFR § 300.101)
- Failure to provide the Student with periodic reports on the progress the Student is making towards annual goals in accordance with the Student’s IEP (34 CFR § 300.320(a)(3))
- Failure to ensure that the PPT for each child with a disability includes not less than one regular education teacher of the child if the child is or may be participating in the regular education environment (34 CFR § 300.321)
Conclusion(s):
- The District and Magnet School are in violation of 34 CFR § 300.101. Due to the Student’s limited progress on IEP goals and objectives, GPA, cumulative earned credits, and that the District and Magnet School did not revise the IEP to contain goals and objectives or services to address the lack of attendance, the Student’s progress is less than de minimis. From the start of the timeline of the complaint, to the end of the 2023-2024 school year, the Student was not provided with a total of 54 hours of academic support, 18 hours of transition services, 54 hours of counseling services, and 9 hours of communication/language services. Corrective action is required. The Student was provided with individual tutoring services and made progress in academic areas; therefore, the District and Magnet School is not required to provide the Student with the missed academic services.
- The District and Magnet School are in violation of 34 CFR § 300.320(a)(3). Progress reports on IEP goals and objectives must be provided to the Student in accordance with the Student’s IEP. Although the District indicated that the Student made limited progress on IEP goals and objectives due to attendance, the District and Magnet School are still required to provide the Student with progress reports on IEP goals and objectives in accordance with the Student’s IEP. The District and Magnet School did not provide the Student with progress reports on IEP goals and objectives consistent with general education grade level report cards in accordance with the Student’s IEP. Corrective action is required.
- The District and Magnet School are in violation of 34 CFR § 300.321. The PPT members present at the PPT meeting on April 17, 2024, include the Parent, the Student, school engagement specialist, school social worker, school psychologist, special education teacher, and the Student’s outside clinician. There was not a regular education teacher of the child at the PPT meeting. At the time of the meeting, the Student was participating in regular education with special education and related services. Corrective action is required.
Corrective Action(s):
- On or before May 4, 2025, the District and Magnet School must develop a compensatory service plan to provide the Student with a current FBA that would inform an updated BIP, 18 hours of transition services, and 9 hours of language/communication services of the missed services. The full measure of missed service hours must be delivered to the Student no later than December 31, 2025. The District must send a copy of the compensatory service plan to the CSDE. Immediately upon delivery of the Student’s full measure of compensatory services, the District shall inform the CSDE.
- The District shall provide training to appropriate staff at the Magnet School in the documentation of Student progress on IEP goals and objectives in accordance with the Students’ IEPs. The District shall provide the CSDE with an attestation that the training has occurred.
- The District shall provide training to appropriate staff at Magnet School in the requirements of ensuring that the PPT for a Student with a disability includes all of the required members including not less than one regular education teacher of the child if the child is or may be participating in the regular education environment. The District shall provide the CSDE with an attestation that the training has occurred.
