Allegation(s):

  • The Parent alleged that the Student’s IEP had not been developed to enable the Student to make appropriate progress based on the Student’s present levels of performance. (34 CFR § 300.101)
  • The Parent alleged that he requested an IEE in writing and that the District had not responded to that request. (34 CFR § 300.502)

Conclusion(s):

  • A review of the associated progress reports demonstrated the Student’s clear progression from addressing skills with which he initially struggled to progress which became primarily satisfactory and, at times, demonstrated mastery; clearly more that de minimis in light of his circumstances. It was concluded that the District was not out of compliance with 34 CFR § 300.10.
  • A Parent’s right to obtain an IEE must be based on disagreement with an evaluation obtained by a district. In this case, the Parent requested the IEE based on a concern that a future evaluation obtained by the District would be inappropriate and he, therefore, would disagree with it. In such case, while this investigator does not challenge that the Parent holds this as a concern, it does not meet the criteria giving the Parent the right to an IEE. It was concluded that the District was not out of compliance with 34 CFR § 300.502 and no corrective actions are issued.
