Allegation(s):

• 34 CFR § 300.111 (Child Find) requires that all children with disabilities residing in the State who are in need of special education and related services are identified, located, and evaluated. 34 CFR § 300.308 states that a child with a disability means a child who has been evaluated as having a disability identified under IDEA and who, by reason thereof, needs special education and related services. The Parent alleged that the Student should be found eligible for special education services as a student with Other Health Impairment (OHI) or Developmental Delay (DD) under IDEA.

Conclusion(s):

• The Student was found not to be eligible under IDEA as a Student with OHI or DD based on a review of records, evaluation results, and progress. It was concluded that the District was not in violation of Child Find.
