Allegation(s):
- Issue: The Student’s January 21, 2025, IEP requires that the responsible staff and service implementer for her Language/Communication goals must be a PROMPT 2 Certified Speech Pathologist. The Parent alleged that as of January 24, 2025, the District had not provided a PROMPT 2 Certified Speech Pathologist to implement the Student’s goals as required. 34 CFR § 300.17(d) requires that special education and related services are provided in conformity with an individualized education program (IEP).
Conclusion(s):
- It was concluded that the District did not provide the PROMPT 2 Certified Speech Pathologist in the frequency and duration specified in the Student’s IEP and was, therefore, out of compliance with 34 CFR § 300.17(d). Prior to the issuance of the complaint findings, the District acknowledged their responsibility to provide the Student with the missed compensatory Language/Communication services, developed a plan for provision and implementation schedule to which the Parent’s agreed and which was memorialized at the Student’s next PPT meeting. Therefore, no further corrective actions were required.
