Allegation(s):

  • Issue: The Parent alleged that the District had failed to conduct the full measure of evaluations for which they had been granted consent 10 months earlier thereby denying the Student FAPE (34 CFR § 300.101). Through investigation, a second violation was revealed regarding reevaluations (34 CFR § 300.303).

Conclusion(s):

  • It was concluded that the Student’s progress was more than de minimis in light if her circumstances, therefore she was not denied FAPE. However, it was further concluded through investigation that the period of time that it took to complete the evaluations was beyond the standard of reasonability and the District was found out of compliance with 34 CFR § 300.303 and corrective actions were issued.

Corrective Action(s):

  1. On or before June 30, 2025, the District shall provide training related to the completion of reevaluations (i.e., any evaluations that are not part of an initial evaluation or evaluations to determine continue eligibility) with respect to the expectation for completion without undue delay. 2. On or before July 15, 2025, the District shall provide the State (at jay.brown@ct.gov) with a copy of any materials used for the training for item 1 above.
