Allegation(s)
The Complainant alleged that the Student was denied a free appropriate public education (FAPE) for the past year. (34 CFR § 300.101).
Conclusion(s)
The District failed to provide specially designed instruction and related services set forth in the Student’s IEPs, which constituted a failure to provide the Student with FAPE. Additionally, its repeated refusal to provide the Student with the therapeutic interventions the Student required in order to return to school constituted, and continues to constitute, a violation of the IDEA. Finally, the District’s failure to review and revise as appropriate the Student’s IEP, choosing instead to provide the same IEP without any substantive changes, which did not meet the Student’s individual needs, is violative of the IDEA.
Corrective Action(s)
- The District shall convene a PPT meeting on a date and at a time mutually agreed to by the District and the Parents, at which meeting the PPT shall recommend the Student’s placement. At the same PPT meeting, the PPT shall recommend a component of in-home services.
- The District shall revise the Student’s IEP in accordance with the orders in corrective action one and shall draft new goals and objectives appropriate to provide the Student with FAPE.
- The District shall provide the Student with compensatory education. The Parent may pick one of the three options below to satisfy this corrective action:
- Provide the Student with up to two additional school years, which if deemed appropriate by the PPT shall include extended-school-year services, of specialized instruction and related services in a therapeutic clinical day program;
- Provide the Student with two additional years of post-graduation therapeutic services; or
- The Parents can elect to have the District monetarily reimburse them for the funds they were compelled to expend to obtain doctors’ notes, as well as therapeutic and educational services they obtained for the Student due to the District’s failure to provide specialized instruction and related services.
- The District shall provide training to its special education administrators and staff on the legal requirements pertaining to students demonstrating school refusal, and the requirement that the PPT comply with their obligation to review IEPs as necessitated by the student’s circumstances and the obligation to conform goals and objectives to the specific special education and related-service needs of such students.
